Supreme Court: DELTA v Uber Brit.

Today the Supreme Court handed down its judgement in DELTA Merseyside Limited & Others v Uber Britannia Limited [2025] UKSC 31.  In following the earlier Court of Appeal decision, the court has dismissed Uber Britannia’s appeal seeking to establish it is “…unlawful for a private hire operator to accept a booking other than by entering as principal into an immediate contract of hire with the passenger to provide the journey…” (at para. 1).  If so, this would bring the Local Government (Miscellaneous Provisions) Act 1976 into line with the Private Hire Vehicles (London) Act 1998.  The court, citing Parliamentary intention and practical application, concurred with the Court of Appeal, found in favour of DELTA Merseyside Limited et al and dismissed the appeal.
