On 21st June 2021 it was reported Nottingham Crown Court had delivered judgement on an appeal, in Cartledge v Gedling Borough Council [2021] (unreported), regarding the delay by a licensing authority in a hackney carriage driver licence renewal determination, which was applied for in good time, and enforcement action. The case centred on the interpretation, and thereby application, of section 77(2) Local Government (Miscellaneous Provisions) Act 1976. Ultimately, the Court allowed the appeal and, in doing so, acknowledged Parliamentary intention on this point within section 17 Transport Act 1985.
