Today the Court of Appeal handed down its judgement on an appeal by Transport for London against the decision of the High Court regarding a challenge to the London Streetspace Scheme and Bishopsgate road restrictions (R (United Trade Action Group & Others) v Transport for London & Others [2021] EWCA Civ 1197). It found (at para. 136):
“…the judge’s decisions both on the lawfulness of the Plan and Guidance and on the lawfulness of the A10 Order had to be set aside. We therefore allowed the appeal and substituted an order dismissing both claims for judicial review…”
It is understood the United Trade Action Group, and Licensed Taxi Drivers Association, intend to seek permission* for an appeal to the Supreme Court.
