Court of Appeal: DELTA v Uber Brit.

Today the Court of Appeal handed down its judgement in DELTA Merseyside Limited & Others v Uber Britannia Limited [2024] EWCA Civ 802.  It concerned an appeal against a decision of the High Court to issue a declaration (at para. 4) that “…in order to operate lawfully under Part II Local Government (Miscellaneous Provisions) Act 1976, a licensed operator who accepts a booking for a passenger is required to enter as principal into a contractual obligation with the passenger to provide the journey…“.  The court, in citing a pre-existing deeming provision (at section 56(1)), ruled in favour of the appeal and discharged the declaration.
