Today the Court of Appeal handed down its judgement in The Independent Workers Union of Great Britain v The Central Arbitration Committee & Others [2021] EWCA Civ 952. It found that riders, engaged by Deliveroo, are not in an employment relationship and do not possess the right to form a trade union (within the meaning of Article 11 European Convention on Human Rights). This decision, notably, goes against recent judgements favouring the designation of worker status.
