Supreme Court: Tesco v USDAW

Today the Supreme Court handed down its judgement in Tesco Stores Ltd v Union of Shop, Distributive & Allied Workers & Others [2024] UKSC 28.  It concerned the permissibility of a so-called “fire and rehire” policy which enabled Tesco to terminate an employees contract and re-engage them on less favourable terms.  The court ruled in favour of the employees, allowing the appeal, and reinstating the earlier High Court injunction against such practices.
