Today the Upper Tribunals Administrative Appeals Chamber (AAC) handed down its judgement in The Information Commissioner v Clearview AI Incorporated & Others [2025] UKUT 319 (AAC). It concerned the reach of the General Data Protection Regulation (GDPR) and whether the ICO has jurisdiction to issue enforcement / penalty notices against a US-based company. The tribunal allowed the appeal and, in doing so, confirmed the ICO does have jurisdiction.
